Hoover, AL Public Conduct: Outdoor Smoking Restrictions (2026)

Section 11-171 is Hoover's Comprehensive Second-Hand Smoke Control Ordinance, codified in Chapter 11, Article IX. Subsection (d) specifically addresses open-air venues: smoking is prohibited in the seating areas of all outdoor arenas, stadiums, and amphitheaters, including bleachers, grandstands, and spectator viewing areas used by the public at sporting or other public events, and the ban extends within fifty feet of the seating areas and entrances and exits of those venues. That outdoor rule sits alongside a broader indoor ban on smoking in enclosed public places under subsection (c), a 10-foot buffer outside doorways of any enclosed area where smoking is barred under subsection (e), and a citywide ban inside every building and vehicle the City of Hoover owns, leases or operates under subsection (b).

The ordinance defines smoking as inhaling, exhaling, burning, carrying or holding any lighted tobacco product or other lighted smoking equipment. 1 of the Code of Alabama in lieu of an arrest warrant. An individual smoking violation carries a fine up to $50. A venue owner, operator or manager who fails to comply with the ordinance or refuses to enforce a no-smoking designation faces escalating fines: up to $100 for a first violation, $200 for a second within a year, and $500 for each additional violation, plus possible revocation of the venue's business license under Chapter 8, Article II, § 8-37. Each day a violation continues is a separate offense.
