Jackson, NJ Public Conduct: Outdoor Smoking Restrictions (2026)

Added to the parks and recreation chapter of the Jackson Township, New Jersey Code by Ordinance No. 51-02 in 2002, § 304-1.R bans smoking on all Township-owned property at all times, expressly including every park and recreational facility in Jackson Township. The rule sits inside the broader § 304-1 list of prohibited park conduct, which also bars littering, unleashed animals outside authorized programs, unpermitted sales and vending, and entry during closed hours, but the smoking ban is the only one of those listed conduct rules that reaches beyond parks to cover all Township-owned property, not just recreation grounds.

Enforcement runs through the Jackson Township Municipal Court rather than through the Recreation Department alone: § 304-1.R(2) sets a graduated penalty ladder tied to how many times a person has been cited. A first offense draws up to 15 hours of community service at a place the Municipal Court designates. A second offense raises that to up to 30 hours of community service and/or a fine of up to $100. A third or later offense can bring up to 50 hours of community service and/or a fine of up to $250.

The ordinance lets the court substitute or supplement the community service with participation in a nonsmoking educational or support program it approves, giving the Municipal Court judge discretion to route repeat violators toward cessation programming rather than only a fine.
