Jefferson County, WI Public Conduct: Outdoor Smoking Restrictions (2026)

Jefferson County Code § 18-100 prohibits smoking indoors at any time in any county-owned, -rented or -leased building, including the Fair Park grandstand, under subsection (a). Subsection (b) extends that 30 feet outward from any public entrance to such a building; at the Fair Park the 30-foot rule applies only to the front door of the activity center. Smoking inside any county-owned, -rented or -leased vehicle is banned under (c). Subsection (d) also lets the county post specific outdoor areas as smoking-restricted, with designated smoking areas at the courthouse fixed adjacent to emergency exits at entrances two and four, and the county administrator or department head can designate smoking areas on other county property.

Subsection (f) is a flat ban regardless of distance: no smoking in park shelters, bathrooms, maintenance buildings or the dog park. The article defines 'smoking' broadly in § 18-99 to include lit or heated tobacco or plant products, hookahs, marijuana whether natural or synthetic, and e-cigarettes or other electronic delivery devices that produce vapor or aerosol. Limited exemptions exist under § 18-101 for sheriff's department interrogation rooms with consent, sheriff's department vehicles, and jurors smoking near courthouse entrance 13 in a bailiff's presence.
