Piscataway, NJ Public Conduct: Outdoor Smoking Restrictions (2026)

Section 3-27, added in 2019 and amended in 2022, defines smoking broadly at § 3-27.1 as burning, inhaling from, exhaling smoke from, or possessing a lighted cigar, cigarette, pipe or any other matter that contains tobacco or can be smoked, plus vaping from an electronic smoking device. Section 3-27.2a extends the ban to every municipal building and facility, indoors and outdoors, naming the Municipal Building, Police Headquarters, the Community/Senior Center, Community Resource and Services, and the Department of Public Works. Section 3-27.2c separately bans smoking in any vehicle registered, owned and operated by the Township.

Wherever the ban applies, the Township must post no-smoking signs, or the international no-smoking symbol, conspicuously at each entrance, written in both English and Spanish under N.J.S.A. 26:3D-55, and each sign must state that violators are subject to a fine. Section 3-27.4 assigns enforcement to the Piscataway Township Police Department. The ban runs alongside a parallel prohibition on consuming cannabis Edibles in the same municipal spaces, and it does not, on its face, extend to sidewalks, streets or private property outside Township ownership or control, which remain governed by the general nuisance and noise provisions elsewhere in Chapter 3.
