Full Breakdown

Section 70-6 sits in Article I (General Provisions) of Chapter 70 (Offenses and Miscellaneous Provisions). Subsection (a)(1) adopts by reference Wis. Stats. § 101.123(1), (2), (2m), (3), (6) and (9), the statewide smoking ban, as if fully set forth in the Code. The outdoor reach comes from subsection (b)(1): no person shall smoke in any city-owned or leased public building or within 25 feet of a main entrance of it at any time.

The code lists the covered sites by address, introduced by the words "including, but not limited to". They are City Hall at 828 Center Avenue, the Public Works Building at 833 Center Avenue, the Sheboygan Transit Building at 608 South Commerce, the Bus Transfer Terminal, the Municipal Service Building at 2026 New Jersey Avenue, five fire stations, Mead Public Library at 710 North 8th Street, the Senior Activity Center at 428 Wisconsin Avenue, the Marina Administration Building at 821 Broughton Drive, the Youth Boating Center at 619 Broughton Drive, the Deland Park Community Center at 901 Broughton Drive, the Wastewater Treatment Facility at 3333 Lakeshore Drive and the Water Utility Building at 72 Park Avenue. The list closes with any other city-owned or rented office and all city-owned or leased motor vehicles.

Subsection (b)(2) bars smoking while in attendance at any public meeting of the common council or its authorized committees, regardless of where the meeting is held. Subsection (b)(3) makes it unlawful for any person to remove, deface or destroy any legally required "No Smoking" sign. For private businesses, subsection (a)(2) lets the person in charge of a restaurant, tavern, private club or retail establishment designate an outside area, a reasonable distance from any entrance, where customers, employees or persons associated with the business can smoke.

Violations & Fines

Under § 70-6(c)(1), a person who violates the incorporated state ban or the additional prohibitions in subsection (b) faces a forfeiture of not less than $100.00 nor more than $250.00 for each violation, plus costs of prosecution, with county jail not exceeding 80 days in default of payment. A person in charge who violates Wis. Stats. § 101.123(2m)(b) to (d) faces $100.00 per violation under (c)(2). Under (c)(3) a first-time person in charge gets a warning notice and no citation, and (c)(4) caps the total at $100.00 plus costs for all such violations on a single day.

Frequently Asked Questions

How far from City Hall do I have to be to smoke in Sheboygan?
Section 70-6(b)(1) bars smoking in a city-owned or leased public building or within 25 feet of a main entrance of it at any time. City Hall at 828 Center Avenue is the first building named in the list. Anywhere beyond 25 feet of a main entrance falls outside this subsection.
Does the ban cover the library and the marina?
Yes. The list in § 70-6(b)(1) names Mead Public Library at 710 North 8th Street, the Marina Administration Building at 821 Broughton Drive, the Youth Boating Center at 619 Broughton Drive and the Deland Park Community Center at 901 Broughton Drive. The list is introduced by the words including, but not limited to, so it is not closed.
Can a Sheboygan bar or restaurant have a smoking area outside?
Section 70-6(a)(2) lets the person in charge of a restaurant, tavern, private club or retail establishment designate an outside area that is a reasonable distance from any entrance where customers, employees or associated persons can smoke. That provision covers private establishments and is separate from the 25-foot rule for city buildings.
What is the fine for smoking too close to a city building in Sheboygan?
Section 70-6(c)(1) sets a forfeiture of not less than $100.00 nor more than $250.00 for each violation, together with the costs of prosecution. If the forfeiture and costs are not paid, the person can be held in the county jail until they are paid, but not to exceed 80 days.
Is smoking allowed at a Sheboygan Common Council meeting?
No. Section 70-6(b)(2) says no person shall smoke while in attendance at any public meeting of the common council or in any of its authorized committees, regardless of the location of the meeting. The rule follows the meeting, so it applies even when the committee meets outside a city building.
