Approved by voters in 2006 as Proposition 201, the Smoke-Free Arizona Act prohibits smoking in workplaces, restaurants, bars, and other enclosed public spaces. The Act extends a 20-foot buffer outside entrances, operable windows, and ventilation intakes. Maricopa County Department of Public Health enforces alongside ADHS. County parks (Estrella, White Tank, McDowell, Lake Pleasant, etc.) restrict smoking to designated areas and prohibit it on trails during fire-restriction season. Vaping was added to the indoor ban under 2022 amendments. Outdoor sidewalks, streets, and unincorporated land remain unregulated for adult smoking. Cities can adopt stricter rules; Tempe banned smoking in city parks in 2017.
Violations are civil infractions under ARS 36-601.01(I), with $50 fine first offense, $200 second, $500 subsequent. Business owners failing to post signs face escalating fines up to $500 plus potential ADHS action. County parks add separate trespass penalties.
