Peoria, AZ Public Conduct: Outdoor Smoking Restrictions (2026)

Chapter 17's smoking article defines an enclosed public place broadly, but three of its prohibitions in Section 17-72(b) reach outdoors. Paragraph (6) bars smoking medical marijuana anywhere in a public or private park's playground area, defined to include swing sets, climbing bars, water features, cushioned play surfaces, and skate parks, plus a fifty-foot buffer measured from the play equipment itself. 9, Arizona's Smoke-Free Arizona Act. Paragraph (8) sets the general entrance buffer: smoking is banned within fifty feet of any entrance to a public place and within fifty feet of any entrance to a licensed childcare facility, adult day care, or health care facility.

The Code carves out limited outdoor exceptions elsewhere in Section 17-72(c): hotel and motel rooms designated for smoking, and outdoor patios, so long as smoke does not drift back into a non-smoking area through doors, windows, or ventilation. Section 17-75(d) folds all of Sections 17-71 through 17-75 into one enforcement scheme: any violation is designated a Class One misdemeanor, and Section 17-75(b) separately makes it unlawful for an owner, manager, operator, or employee of a covered establishment to permit smoking where it is prohibited.
