Peoria, AZ Public Conduct: Public Urination (2026)

Section 13-63(a) bars urinating or defecating in a public place, and extends the ban to any other location, public or private, where the conduct is actually observed by someone who has a legal right to be present at the spot from which they saw it, closing off the argument that a fence, an alley, or a parked car makes an act private as long as a lawfully present witness sees it happen. Subsection (b) protects normal use of restrooms, portable toilets and similar facilities that a landowner or the city has specifically built and designed for that purpose, so the ordinance targets conduct done in the open rather than lawful restroom use. The section was enacted by Ordinance No. 94-80 on December 6, 1994, and sits in Chapter 13's public-conduct sections alongside Peoria's prostitution, solicitation and aggressive-panhandling offenses, all of which the Peoria Police Department enforces through citation and, where charged criminally, prosecution in Peoria Municipal Court.
