Scottsdale, AZ Public Conduct: Outdoor Smoking Restrictions (2026)

Scottsdale Code § 19-15, added by Ordinance No. 4681 effective July 1, 2025, makes it unlawful to smoke on or within fifty (50) feet of any playground on city property. The section defines smoking broadly: inhaling, exhaling, burning, or carrying or possessing any lighted tobacco product, including cigars, cigarettes and pipe tobacco, and extends the ban to electronic cigarettes 'to the extent permitted by law.' This is a distinct, more recent provision from the city's long-standing Smoking Pollution Control Ordinance at § 19-16, which regulates smoking inside enclosed public places and workplaces, such as restaurants, retail stores and offices, and carries its own petty-offense fine schedule up to $300 for individuals and $1,000 for enterprises with a $25/$250 mandatory minimum. Section 19-15 instead targets outdoor conduct specifically at city playgrounds, giving Scottsdale a direct, quotable outdoor smoking rule for parks rather than relying solely on the indoor-focused 1986 ordinance.
