Summary
Broken Arrow makes it unlawful to drink or otherwise consume intoxicating liquor in any public place, or to appear drunk in a street, vehicle, or public place.
(a)It shall be unlawful for any person who is drunk or in a state of intoxication to appear or be upon or in any street, alley, vehicle, place of business or other public place.(b)It shall be unlawful for any person to drink or otherwise consume any intoxicating liquor in public, except as authorized by the Oklahoma Alcoholics Beverage Control Act.(c)It shall be unlawful for any person to be drunk or intoxicated from any cause and disturb the peace of any person.(d)It shall not be a violation for any person to be intoxicated on the premises of a private residence with the prior express consent of the owner or any bona fide resident.(e)Any person who violates section (a) shall be punished by a fine of not less than $10.00 nor more than $100.00 or by imprisonment of not more than 30 days, or both such fine and imprisonment.
