Full Breakdown

Idaho Falls City Code § 8-3-4(B) makes it a misdemeanor to possess an alcoholic beverage, beer, wine, or liquor, in any public park, outdoor recreation area or facility, or adjacent public parking lot within city limits, unless authorized by the Code or Idaho Code. The two exceptions are: drinking within the posted premises of a retail licensee authorized to sell alcohol at that location, and consuming alcohol during a City-approved Permitted Event under § 8-3-5, which requires a Clerk-issued permit, fee, and compliance with the ordinance's approved locations and service hours.

Violations & Fines

Possessing an open alcoholic beverage in a City park or adjacent lot without an exception is a misdemeanor under § 8-3-4(B); officers can cite on sight, and it can affect future Permitted Event eligibility.
