Kentucky permits municipalities to designate Entertainment Destination Centers (EDCs) under KRS 243.0305 where open containers are allowed. Louisville Metro has activated EDCs at Fourth Street Live and parts of NuLu during specific hours, allowing patrons to carry plastic cups of alcohol within posted boundaries. Outside these zones, drinking from open containers in public ways, parks, or vehicles violates Louisville Metro nuisance and Kentucky open-container statutes. Glass containers are prohibited even within EDCs. Kentucky Derby infield rules and Bourbon Trail tasting events operate under separate ABC permits.
Open-container violations are Class B misdemeanors under Kentucky law, punishable by fines up to $250 and up to 90 days jail. DUI overlay charges under KRS 189A.010 carry far heavier penalties.
