Middletown, OH Public Conduct: Public Alcohol Use (2026)

Section 612.07(b) lists circumstances where an opened container is illegal in the City of Middletown, Ohio: inside a State liquor store, on the premises of any Division of Liquor Control permit holder, in any other public place, and while operating or riding in a stationary or moving vehicle on any public or private property open to vehicular travel or parking. The ban reaches both drivers and passengers, whether the vehicle is moving or parked.

The section carries narrow exceptions built around specific state liquor permits. A person may carry an open container of alcohol lawfully bought for on-site consumption from an A-1-A, D-1, D-5 series, or similar permit holder, or wine served as a tasting sample at a farmers market under an F-10 permit. Music festivals held on at least 40 acres over three or more consecutive days may let an F permit holder authorize outside alcohol. Outdoor performing arts centers of at least 150 acres, open April through October, may allow wine or beer during orchestral performances of 40 or more musicians. Outdoor motorsports facilities of at least 200 acres with a 2.4-mile track may permit alcohol during racing events. Passengers, other than the driver, in a chauffeured limousine under a prearranged contract are exempt, as is a securely resealed wine bottle stored in a vehicle's trunk.

None of these carve-outs cover ordinary sidewalks, parks, or parking lots downtown or along the Great Miami River; outside those specific licensed settings, an open container in public remains illegal citywide.
