Oyster Bay, NY Public Conduct: Public Alcohol Use (2026)

Chapter 82, adopted June 18, 1985 by Local Law No. 2-1985, makes it a violation under § 82-3 to consume any alcoholic beverage in any public place in the Town of Oyster Bay, or to possess an open or unsealed container of one in a public place for the purpose of drinking it yourself or handing it to someone else. "Public land" under § 82-2 covers highways, streets, sidewalks, parking lots, parks, playgrounds, public buildings and transportation facilities within the town's unincorporated area. Under § 82-5, simply holding an open or unsealed container on public land is presumptive evidence you intend to drink from it, so an officer does not need to see you actually take a sip to write a summons.

Section 82-4 carves out exceptions for drinking authorized by a state or town license or permit, or at a gathering or function that the town's appropriate governing body, board, agency or commission has already approved, such as a permitted street fair or beer garden. The law is enforced by Town of Oyster Bay police and the Bureau of Administrative Adjudication, which can impose the same fine range set out in § 82-6 against anyone it finds in violation. Because Oyster Bay is a town, this chapter reaches only the unincorporated hamlets and does not apply inside the roughly twenty incorporated villages within the town's borders, such as Bayville or Massapequa Park, each of which enforces its own separate village code.
