Sanford, FL Public Conduct: Public Alcohol Use (2026)

Sanford City Code Section 6-7 splits public alcohol restrictions into two categories. Subsection (a) makes it unlawful to consume or possess any alcoholic beverage in a publicly owned park or recreation area, on public school property, or at any municipally owned recreation center or swimming pool, with no carve-out for open or closed containers; possession alone is enough. Subsection (b)(1) covers streets, sidewalks and parking: it is unlawful to consume or possess alcohol in an open container on any public street, thoroughfare or sidewalk, unless a licensed sidewalk cafe is serving it, and unlawful to possess an open container of alcohol while in or on a motor vehicle in any public or semi-public parking facility.

The city commission carves out one exception: under a special event permit, beer and wine may be dispensed and consumed in public or semi-public areas for up to two days (48 hours), with the daily hours set by the city manager, provided the event organizers follow all local, state and federal alcohol laws. Subsection (b)(2) extends the open-container rule to privately owned property, making it unlawful to consume or possess an open container there too unless the person is a lawful guest with the owner's consent.

Because Chapter 6 does not set out its own penalty for a Section 6-7 violation, enforcement runs through the Code's general penalty at Section 1-7: a fine of up to $500, up to 60 days in jail, or both, and each day or instance of continuing violation may be charged separately.
