West Hartford, CT Public Conduct: Public Alcohol Use (2026)

Town Code Chapter 45, Article II, adopted July 19, 2011, makes it unlawful under § 45-3 to consume alcoholic liquor or possess an open container of it upon or within the limits of any highway, public area, or parking area in West Hartford. The code defines an open container broadly: any open bottle, any bottle whose liquor-tax-stamp seal is broken, any opened can, or any keg, dispensing device, glass, cup or jar. The prohibition explicitly covers consumption or an open container inside a parked vehicle sitting in a parking area or on a highway or sidewalk, closing the obvious loophole of just sitting in your car.

"Highway" is defined to include sidewalks but excludes an outdoor dining area approved under the Town's Zoning Ordinance, so a licensed sidewalk cafe under Chapter 177 is not swept in. Section 45-4 carves out three exceptions: any permitted function, festival, event or celebration authorizing on-site sale and consumption; drinking on a highway within 100 yards of your own residence; and drinking on the public sidewalk within the property lines of a residence hosting a social event. Enforcement falls to the West Hartford Police Department, and § 45-5 sets the penalty for a § 45-3 violation at whatever fine schedule is set under the Town's general penalty provision, § 1-8 of the Code of Ordinances.
