Medford, OR Public Conduct: Public Marijuana Use (2026)

705 of the Medford Code states it is unlawful for any person to engage in the use of marijuana items in a public place, and classifies a breach as a "violation" rather than a crime. 700 supplies the definitions that give the ban its reach: "marijuana items" cover marijuana itself plus cannabinoid products, cannabinoid concentrates, and cannabinoid extracts, so the ban is not limited to smoking dried flower but also reaches vaping cannabis extract or eating a cannabinoid edible in public. 700(9) to include hallways, lobbies, and other common areas of apartment buildings and hotels not making up a resident's own unit or room, plus highways, streets, schools, places of amusement, parks, playgrounds, and areas used for public passenger transportation.

990(2): a fine not to exceed $250, with no imprisonment and no criminal disability. 725) added by Ordinance No. 2016-59 on May 19, 2016, which separately criminalizes providing marijuana to a visibly intoxicated person or to someone under 21 as felonies punishable up to $1,000 and possible jail time, showing the Council treated simple public consumption as a lower-tier offense than distribution to minors or intoxicated persons.
