45, adopted by Ord. 2017-230 on December 20, 2017, prohibits marijuana smoking and consumption on all property the city owns, leases or operates. 020 defines CITY PROPERTY broadly to include city facilities, parking lots, streets, rights of way, parkways, parks, buildings and sidewalks, so the ban follows the city onto every public-facing site it controls, not just parks or government buildings. 020 also defines MARIJUANA SMOKING to cover combustion, electrical ignition or vaporization from any cigar, cigarette, cigarillo, pipe, hookah or electronic smoking device loaded with a marijuana product intended for human inhalation, so vaping and edibles-adjacent combustion devices are swept in along with traditional smoking.

030 makes clear the chapter stacks on top of, rather than replaces, any state or federal smoking prohibition already in effect at a location, and it bars the city from ever designating a marijuana smoking area on its own property. 010 is protecting public health from secondhand smoke and keeping city facilities, streets and natural resources clean for residents and visitors. 050 leaves enforcement open to any means legally available, which in practice includes administrative citation alongside nuisance abatement. 060 preserves the rest of the chapter if a court strikes any single provision.
