Troy, MI Public Conduct: Public Marijuana Use (2026)

01, adopted under the city's police-power authority following Michigan's Regulation and Taxation of Marihuana Act. Subsection (c) is the operative public-use rule: no person may consume marihuana in a public place, and no person may smoke marihuana anywhere a property owner, occupant or manager has prohibited it. The section carves out one exception: a public place does not include an area designated for consumption within a municipality that has authorized consumption in designated areas that are not accessible to persons under 21 years of age, meaning the ban applies citywide unless Troy itself creates such a designated area.

The subsection sits alongside companion rules in the same section: subsection (a) bars anyone under 21 from possessing or consuming marihuana without a medical registry card, subsection (d) bars visible outdoor cultivation, and subsection (e) separately bans smoking marihuana inside a vehicle on a public way. 00 plus forfeiture of the marihuana itself, the same schedule that applies to violations of subsections (a), (b), (d) and (g). The Troy Police Department enforces the section, issuing civil infraction citations rather than criminal charges for public consumption, though the separate vehicle-smoking and school-grounds provisions in subsections (e) and (f) escalate to a 90-day misdemeanor.

The current text was revised February 19, 2024 and took effect March 21, 2024. Because forfeiture is written into the penalty, officers seize the marihuana at the time of citation regardless of the amount involved.
