The city council finds and declares that, notwithstanding any other provision of the Municipal Code, it is a public nuisance and unlawful for any person owning, leasing, occupying, or having charge of any property or premises in the city to allow, cause, create, maintain, or suffer, or permit others to cause, create, or maintain the following conditions on such property or premises: ... (C) Any real property, or any building or structure thereon, that is used by any person to cause, allow, contribute to, permit, or suffer any of the following acts including, but not limited to: (1) Disturbances of the peace; (2) Excessive and/or loud noise disturbances; (3) Consumption of alcohol in public and/or public intoxication; (4) Urination in public; (5) Excessive littering; (6) Lewd and/or lascivious conduct; (7) Excessive responses by the police department or other law enforcement personnel; and/or (8) Unpermitted or unlicensed massage therapist or massage establishment.

030(C) of the Real Property Nuisances chapter, adopted by Ordinance 4667 in 2015, targets property used to facilitate a list of public-order offenses. It makes it a public nuisance for "any real property, or any building or structure thereon" to be used by any person to "cause, allow, contribute to, permit, or suffer" disturbances of the peace, excessive noise, public alcohol consumption or intoxication, urination in public, excessive littering, lewd or lascivious conduct, excessive police responses, or an unpermitted massage establishment. Urination in public is item (4) on that list. 020 and ordered to abate it. 160. 13, with each day the condition continues charged as a separate offense.
Violations & Fines
Allowing public urination on real property violates § 6.26.030(C)(4) and is punishable under § 6.26.040 as a misdemeanor per § 1.12.010, or by administrative fine under Chapter 1.13. The City Attorney may instead charge the offense as an infraction. Each day the nuisance use continues is a separate violation, and the city can pursue abatement, a hearing before a hearing officer, and cost recovery against the responsible property owner or occupant.
