Summary

Section 11-02-160 of the Prescott Valley Town Code bars anyone on roller skates, or riding a coaster, skateboard, motorized skateboard or similar device, from any roadway in the Town of Prescott Valley, except while crossing a street on a crosswalk, where the rider has the rights and duties of a pedestrian. Town parks add their own rules in Section 10-02-040.

No person upon roller skates or riding any coaster, skateboard, motorized skateboard, play vehicle, motorized play vehicle, or similar device may go upon any roadway except while crossing a street on a crosswalk and, when crossing, such person shall be granted all of the rights and shall be subject to all of the duties applicable to pedestrians. For the purpose of this Chapter, Motorized Play Vehicle is defined as a coaster, scooter, or any other alternatively fueled device or other motorized vehicle that is self-propelled by a motor or engine and is not otherwise defined in Arizona Revised Statutes, Title 28 (as amended) as a “motor vehicle,” “motor-driven cycle” or “motorized wheelchair.”

Full Breakdown

Section 11-02-160, titled Use of Coasters, Roller Skates, Motorized Play Vehicles and Similar Devices Restricted, sits in Article 11-02, Traffic Control, of the Town Code of the Town of Prescott Valley, Arizona. It bars a person on roller skates, or riding any coaster, skateboard, motorized skateboard, play vehicle, motorized play vehicle or similar device, from going upon any roadway. The one exception is crossing a street on a crosswalk, and a person who crosses there is granted all of the rights and is subject to all of the duties applicable to pedestrians. The section addresses roadways only and does not mention sidewalks.

The section also defines Motorized Play Vehicle for the Chapter: a coaster, scooter, or any other alternatively fueled device or other motorized vehicle that is self-propelled by a motor or engine and is not otherwise defined in A.R.S. Title 28 as a motor vehicle, motor-driven cycle or motorized wheelchair. The text was repealed and re-enacted by Ordinance No. 757 on 04/28/11.

Town parks carry a second layer of rules in Section 10-02-040. For the Mountain Valley Skate/Bike Park, off-leash areas, Pickleball Courts and parks with synthetic athletic turf, Subsection B(7) prohibits motorized and non-motorized devices including unicycles, bicycles, tricycles, scooters, skateboards, in-line skates and strollers, except as otherwise permitted within the Mountain Valley Skate/Bike Park, and exempts wheelchairs and other mobility aid devices. Inside the Skate/Bike Park, Subsection B(15) describes a non-supervised activity site designed for skateboarding, in-line skating and BMX biking only, recommends a helmet, elbow pads and knee pads, bars spectators and added obstacles such as benches and tables, bars bike pegs, and requires approval from the Parks and Recreation Director for amplified music. Organized programs, lessons and scheduled events in these parks need express approval from the Parks and Recreation Department under Subsection B(1).

Violations & Fines

Section 11-02-160 prints no penalty of its own. Section 1-08-010(A) treats a Code violation with no specific penalty as a class 1 misdemeanor, and Section 1-08-010(B) also makes any Code violation a civil offense carrying a civil sanction not to exceed $2,500, each day a separate offense. Violations of the park rules in Article 10-02 are misdemeanors under Section 10-02-070, which points back to Section 1-08-010(A).
