Full Breakdown
Section 10-02-040(B) of the Prescott Valley Town Code sets rules for what it calls Specialty Parks: Mountain Valley Skate/Bike Park, designated off-leash areas, Pickleball Courts, and Town parks, playgrounds and outdoor recreational areas in which synthetic athletic turf has been installed. Rule 5 provides that users shall not possess and/or consume tobacco (in any form) while using the Specialty Parks. The wording is broader than smoking alone, because possession and every form of tobacco are covered. Authorized Town officials can expressly permit an otherwise prohibited activity.
The tobacco rule sits in the Specialty Parks list, not in the all-parks list in subsection A, so the Town Code as printed does not extend it to every Town park. Other Specialty Parks rules show how tightly these sites are managed: consumption of any beverage other than water in clear plastic containers is prohibited, consumption of any food is prohibited, and in the athletic turf areas any open flames, including lighters and grills, are prohibited within twenty (20) feet of the turf area.
Marijuana is covered separately in Chapter 10, Article 7. Section 10-07-030(B) makes it unlawful for an individual to smoke marijuana or marijuana products on public property, in a public space, or open space in the Town, and Section 10-07-060 prohibits consumption where reasonable notice has been given by a person who occupies, owns or controls the property. The code does not print a general ban on tobacco smoking on restaurant patios in these provisions.
Violations & Fines
Section 10-02-070 makes any violation of Article 10-02 a misdemeanor under Section 1-08-010(A), a class 1 misdemeanor, with each day a separate offense. Section 1-08-010(B) also lets a Town Code violation be charged as a civil offense with a civil sanction not to exceed $2,500. Under Section 10-07-070(A), each day a violation of the marijuana article continues is a separate offense.
