Summary
In the City of San Jacinto, California, no one can propel a skateboard or motorized skateboard on a sidewalk, bikeway, bicycle path, equestrian trail, or hiking or recreational trail inside a park or recreation area, unless that area has been set aside for skateboarding. A violation is a misdemeanor.
No person shall propel any skateboard or motorized skateboard on any sidewalk, bikeway, bicycle path or trail, equestrian trail, or hiking or recreational trail within any park or recreation area unless such area has been set aside for such use.
Full Breakdown
The skateboard rule is Section 12.24.160 of the San Jacinto Municipal Code, part of Chapter 12.24 Public Parks. It names two kinds of board, the ordinary skateboard and the motorized skateboard, and it lists the surfaces covered: any sidewalk, bikeway, bicycle path or trail, equestrian trail, and hiking or recreational trail. The section applies inside a park or recreation area. The code defines "city park and recreation areas" in § 12.24.020 as all grounds, buildings, improvements and areas dedicated for use by the public for park, recreation or open space purposes, including parking lots, whether developed or undeveloped.
The only exception printed in § 12.24.160 is an area that has been set aside for skateboarding. A rider who finds a posted skate area can use it. Everywhere else in the park, the paths and walkways are closed to boards. A related rule in § 12.24.060(B) bars playing or engaging in active sports or games in a park except on areas set aside for such use, unless the director expressly authorizes it, and the director is the city manager or his or her authorized representative.
Park hours also apply to skaters. Under § 12.24.050 parks and their parking lots are closed to the public from eight p.m. to six a.m. between October 1st and March 31st, and from nine p.m. to six a.m. between April 1st and September 30th, with a later closing for lighted fields and courts. The director sets additional park rules under § 12.24.030 and posts them where posting is feasible. Section 12.24.040 makes anyone entering a park responsible for complying with the chapter and all related provisions of the code, and names the chief of police or city code enforcement officers as the officials who enforce it. The chief of police or fire chief can also close a park or part of it under § 12.24.140 when conditions present a hazard to public safety.
Violations & Fines
Section 12.24.210 makes any violation of Chapter 12.24 a misdemeanor. On conviction the punishment is a fine of not more than one thousand dollars ($1,000), imprisonment not to exceed six months, or both. The chief of police or city code enforcement officers enforce the chapter under § 12.24.040, so a skateboarder on a park path can be cited by either.
