Full Breakdown

Skating in the Village of Southampton is regulated by § 82-7C and § 82-7D of the Village Code, in Chapter 82, Peace and Good Order. Subsection C has two sentences, and each is its own ban.

The first sentence prohibits riding, using or operating any skateboard, roller skates, in-line skates, roller blades or similar device upon any streets, sidewalks, parking area or public place within the area designated as the VB Business District in Chapter 116, Zoning. The only exception is a place specifically designated for such use, and § 82-7 itself designates none. The second sentence applies the same prohibition to a listed street, printed in the code as Culver Street: Pond Lane, and it covers the entire width, including the paved portion normally devoted to the operation and parking of motor vehicles and the portion normally devoted to pedestrian traffic, including sidewalks. The Board of Trustees amended subsection C in 1992, 1995 and 1998.

Subsection D, added on June 23, 1998 by Local Law No. 3-1998, reaches beyond the business district. It defines reckless operating as operating, using or riding on any bicycle, skateboard, roller skates, in-line skates, roller blades or similar device upon any public street in the Village in a manner which unreasonably interferes with the free and proper use of the public street or unreasonably endangers users of the public street, and it states that reckless operating is prohibited.

Section 82-5 adds a general backstop for all public places: it is unlawful to play ball except at places specifically designated, throw stones or do any act, amusement or practice endangering property or persons on the streets, highways or public places of the Village. Violations of Article I are punished under § 82-11.

Violations & Fines

Section 82-11 sends violations to Article II of Chapter 1. Section 1-17 makes a conviction a violation under the Penal Law, punishable by a fine not exceeding $2,000 or imprisonment for a term not exceeding 15 days, or both, with community service as the court directs. A continuing violation counts as a separate offense for each day.

No. Subsection C bans skateboards, roller skates, in-line skates, roller blades and similar devices on streets, sidewalks, parking areas and public places within the VB Business District, except at a place specifically designated for such use. Section 82-7 itself designates no such place.

Subsection D defines it as operating, using or riding a skateboard, skates, roller blades or similar device on a public street in a manner which unreasonably interferes with the free and proper use of the street or unreasonably endangers its users. The same definition covers bicycles.
