Summary

In the Village of Southampton, § 82-3 bans drinking alcohol on any Village street, park, sidewalk, recreation area, beach access road or parking area, and on sidewalks or parking areas kept up by a business open to the public. Carrying an open container at those places is also unlawful. Licensed sidewalk dining areas are the exception.

A. No person shall drink or consume any beer, wine, liquor or other alcoholic beverage at or on any street, park, sidewalk, recreation area, beach access road or parking area which is owned, controlled, operated or maintained by the Village of Southampton, New York, nor upon any sidewalk, parking area or similar place maintained by a place of business which is open to the public, nor carry or have in his possession any open container containing any such alcoholic beverage at any such place. B. Subsection A above shall not apply to service of alcoholic beverages for consumption on Village property or on a Village sidewalk at a sidewalk dining area operated by a licensed business pursuant to a license issued by the Village Clerk for use of the Village property or sidewalk for outdoor dining, provided that such use is conducted in compliance with such license and in compliance with rules and regulations established by resolution of the Board of Trustees for use of the Village property or sidewalk for outdoor dining.

Full Breakdown

Section 82-3 of the Southampton Village Code, in Chapter 82 (Peace and Good Order), has two operative parts. Subsection A prohibits two things at the same list of places: drinking or consuming any beer, wine, liquor or other alcoholic beverage, and carrying or having in possession any open container containing such a beverage. The places are any street, park, sidewalk, recreation area, beach access road or parking area owned, controlled, operated or maintained by the Village of Southampton, plus any sidewalk, parking area or similar place maintained by a place of business which is open to the public. That second category reaches business-maintained ground that is not Village property.

Subsection B carves out sidewalk dining. The ban does not apply to service of alcoholic beverages for consumption on Village property or on a Village sidewalk at a sidewalk dining area operated by a licensed business under a license issued by the Village Clerk for outdoor dining. The business must comply with the license and with rules the Board of Trustees establishes by resolution. The section's amendment history lists changes on November 14, 1980, January 29, 1982 and June 21, 2005, and subsection B carries a further amendment dated May 11, 2023 (L.L. No. 10-2023).

On the ocean beach, § 80-1J separately makes it unlawful to come upon or remain on the area while intoxicated or under the influence of alcoholic beverages to such an extent that normal faculties are impaired or conduct is offensive to other persons. That beach rule turns on impairment, while § 82-3 turns on the act of drinking or holding an open container, so no impairment is needed for a citation under § 82-3.

Violations & Fines

Section 82-11 punishes violations of Article I of Chapter 82, including § 82-3, under Article II of Chapter 1 of the Village Code. Under § 1-17 a conviction is a violation pursuant to the Penal Law of the State of New York, punishable by a fine not exceeding $2,000, imprisonment not exceeding 15 days, or both, with community service in the court's discretion. Each day counts separately for a continuing violation, and § 1-18 preserves revocation or suspension of a license or permit, which matters for a sidewalk dining licensee.

Frequently Asked Questions

Can I drink alcohol in a Village of Southampton park?
No. Section 82-3A prohibits drinking or consuming any beer, wine, liquor or other alcoholic beverage at or on any street, park, sidewalk, recreation area, beach access road or parking area owned, controlled, operated or maintained by the Village. The only exception in § 82-3B is service at a licensed sidewalk dining area on Village property or a Village sidewalk.
Is it illegal to carry an open container on a sidewalk?
Yes at the covered places. Section 82-3A makes it unlawful to carry or have in possession any open container containing an alcoholic beverage on a Village street or sidewalk, or on a sidewalk, parking area or similar place maintained by a place of business open to the public. The text reaches possession as well as drinking, so you do not have to be sipping from the container to be in violation.
How do restaurants serve alcohol outdoors in the Village?
Under § 82-3B, a licensed business can serve alcoholic beverages for consumption on Village property or a Village sidewalk at a sidewalk dining area if it holds a license from the Village Clerk for outdoor dining and operates in compliance with that license and with rules the Board of Trustees sets by resolution. Service outside the licensed area is not covered by the exception.
What is the penalty for drinking in public in the Village?
Section 82-11 refers violations to Chapter 1, Article II. Under § 1-17 a conviction is a violation under the New York Penal Law carrying a fine not exceeding $2,000, imprisonment not exceeding 15 days, or both, with community service directed at the court's discretion.
