No person shall act as or be engaged as a food handler unless such person: (1) possesses a valid food handler training certificate as described in subdivision (a) of this section, or (2) is working in an establishment under the supervision of a food service manager possessing a food service manager training certificate as described in subdivision (b) of this section, and possess a food handler card as described in subdivision (c) of this section; however, a person may act as or be engaged as a food handler under the supervision of such a food service manager for up to ten (10) calendar days without a food handler card.

Full Breakdown

26 bars a person from acting as a food handler unless they hold a valid food handler training certificate, or work under the supervision of a certified food service manager and hold a food handler card, with an allowance to work up to 10 calendar days under such a manager without the card first. The food handler training certificate requires successfully completing a health-officer-approved food sanitation course of at least three hours covering microorganisms, foodborne disease sources, contamination pathways, prevention methods, disease control, personal hygiene, utensil and equipment handling, and dishwashing procedures, then passing a proficiency test with at least a 70 percent grade; the certificate is valid for three years.

A food service manager certificate instead requires a 16-hour course and an 85 percent grade on the proficiency test if using academic/experience substitutes, or 70 percent for the standard 16-hour course path, and this manager certificate does not expire. A food handler card issued by a certified manager requires the food handler to pass a sanitary-practices test with at least a 70 percent grade, and it stays valid for three years, or until the employee stops performing food-handling services, or 60 days after the establishment loses its certified food service manager, whichever comes first.

29 requires the establishment's owner or operator to maintain on-site records of every food handler and manager employed, plus copies of their certificates and cards, and to produce those records to the health officer on request whenever the establishment is open.

Violations & Fines

Working as a food handler without a valid food handler card, training certificate, or qualifying manager supervision, or an owner failing to maintain and produce on-site food handler and manager certification records under Section 12.29, violates Chapter 12 and is enforceable by the health officer, who can require exclusion of noncompliant workers under Section 12.25.

Frequently Asked Questions

How long is an Oceanside food handler card valid?
Section 12.26(c) sets a three-year validity period from issuance, but the card also expires early if the food handler stops performing food-handling services at that establishment, or 60 days after the establishment no longer has a certified food service manager on staff, whichever happens first.
What passing score does an Oceanside food handler need on the training test?
Section 12.26(a) requires at least a 70 percent grade on a health-officer-approved proficiency test after completing a minimum three-hour food sanitation course covering topics like foodborne disease, personal hygiene and dishwashing procedures.
Can a new employee work before getting an Oceanside food handler card?
Yes, for up to 10 calendar days, but only while working under the direct supervision of a food service manager who holds a valid food service manager training certificate, per Section 12.26.
