Summary

Clifton's Health Department requires every retail food-handling establishment to post its current inspection evaluation placard where patrons entering the premises can see it. The placard must sit in one of four approved spots near the main entrance, and covering, defacing or hiding it is a separate violation under Chapter 245 of the Clifton Code.

Every establishment must post the most current evaluation placard issued by the Health Department according to the following requirements: (1) The evaluation placard must be posted conspicuously in one of the following prominent locations, clearly visible to the patron entering the establishment: (a) The main entrance door, from four to six feet of the ground or floor. (b) A front window within three feet of the main entrance. (c) A display case mounted on the outside wall within three feet of the main entrance. (d) If there is no main entrance door, front window or a display case mounted on the outside wall within three feet of the main entrance, directly below a wall-mounted menu. (2) The placard shall not be defaced, marred, camouflaged, or hidden from public view.

Full Breakdown

The Health Officer or another enforcing official designated under Chapter 245 inspects every retail food-handling establishment as often as deemed necessary, and operators must give inspectors access to all areas plus food-purchase records on request. When a reinspection is needed for any reason during the calendar year, the fee is tiered to the establishment's initial permit fee: $100 for permits up to $155, $175 for permits from $156 to $299, $225 for permits over $299, and $300 for permits over $499. Section 245-6C sets four acceptable placard locations, all chosen so a patron sees the grade before entering: the main entrance door between four and six feet off the ground, a front window within three feet of the main entrance, an outside display case within three feet of the main entrance, or, lacking any of those, directly below a wall-mounted menu.

The placard cannot be defaced, marred, camouflaged or hidden from public view; concealment is treated as its own violation. Chapter 245 also lets the enforcing official close an establishment immediately and post a notice under Section 245-8 if it may be a source of food-borne disease. The placard requirement was last amended by Ord. No. 7458-18 on 7-3-2018, following earlier amendments in 2007 and 2017 that built out the reinspection fee schedule.

Violations & Fines

Violating any provision of Chapter 245, including the placard-posting and placard-concealment rules in Section 245-6C, is punishable under Section 245-12 by a fine of up to $500, imprisonment for up to 90 days, or both. Each day the placard stays hidden, defaced or missing counts as a separate offense, so multi-day concealment can multiply the fine well beyond the single-violation cap.

Frequently Asked Questions

Where must a Clifton restaurant post its inspection placard?
Section 245-6C gives four choices, all meant to be visible before a patron enters: on the main entrance door between four and six feet above the floor, in a front window within three feet of the entrance, in an outside display case within three feet of the entrance, or, if none of those exist, directly below a wall-mounted menu. The placard must show the most current evaluation issued by the Health Department.
Can a restaurant cover up a bad placard?
No. Section 245-6C(2) specifically bars defacing, marring, camouflaging or hiding the placard from public view, and doing so is enforced as a distinct violation of Chapter 245, exposing the operator to the same $500 fine and 90-day jail exposure set out in Section 245-12 for any other violation of the chapter.
How much does a Clifton restaurant reinspection cost?
Fees are tiered to the establishment's original permit fee under Section 245-6B: $100 for permits up to $155, $175 for permits between $156 and $299, $225 for permits over $299, and $300 for permits over $499. The fee applies whenever a reinspection is required for any reason during the calendar year.
Who enforces Clifton's food establishment placard rule?
The enforcing official is the City Health Officer, or another official licensed by the State Department of Health and designated by Clifton's Health Department, per Section 245-1's definition of 'enforcing official.' That official inspects retail food-handling establishments as often as necessary and can order closure under Section 245-8 if a health hazard is found.
