Section 8.42.080 sets the baseline: it is unlawful to throw, discard, place or deposit infectious waste in any manner or amount on public or private property in the city except in a container or area lawfully provided for it. Section 8.42.090 spells out how generators, defined broadly in § 8.42.010(B) to include everyone from hospitals and physicians' offices to individuals disposing of their own sharps, must comply: infectious waste goes into a red bag or sharps container marked 'BIO HAZARD' in capital letters, secured with string, wire or adhesive, and picked up by a private commercial sanitation company or medical waste facility.

The section gives individual sharps generators a specific alternative: they may take their sharps to a pharmacy that participates in the city-sponsored sharps disposal program instead of arranging commercial pickup. Blood-soaked absorbent items get the same red-bag, BIO HAZARD-label treatment under subsection 2, while other decontaminated waste can go into a regular city dumpster or sanitation container under subsection 3. Enforcement is handled by city zoning enforcement personnel, city police officers, or the city manager's designee under § 8.42.110, who can issue a citation under § 8.42.111.
