Every rental unit in Edison must be registered with the Township Clerk under Code Chapter 17 and licensed before occupancy. The license year runs from March 1 through February 28; on expiration a new registration is required. The chapter layers a Rental Re-Occupancy Inspection by the Edison Division of Health on every new tenancy. First-offense violation of the registration requirement carries a $200 fine in Edison Municipal Court, $500 for a second offense, and the Chapter 1 §1-5 maximum thereafter. Newly constructed buildings with more than four rental units are exempt from the re-occupancy inspection (not the registration) for two state licensing periods after the certificate of occupancy.
Code Chapter 17 sets two parallel obligations on every Edison rental. The first is registration with the Township Clerk - 'all rental units shall be registered with the Township Clerk of the Township of Edison, or their designee, or such other person as designated by the Mayor of the Township of Edison; upon proper registration and payment of all fees a license shall issue for the rental unit so registered.' The license term commences March 1 each year and expires the following February 28, at which point a new registration is required. The chapter applies to one-family and multi-family rentals alike (subject to the New Jersey Landlord Identity Registration carve-out at N.J.A.C. 5:10-1.11 for owner-occupied two-unit and three-unit buildings, which the state administers separately). The second obligation is the Rental Re-Occupancy Inspection, administered by the Edison Division of Health: 'before any new tenant moves into a rental unit, an application for a Rental Re-Occupancy Inspection must be filed with the Division of Health. The Division of Health will conduct an inspection within seven (7) working days of receipt of the application but no earlier than seven (7) days prior to the expected date of vacancy.' On substantial compliance the inspector issues a Rental Certificate of Approval immediately; absent the certificate the unit may not be occupied until reinspection. Newly constructed buildings of more than four rental units receive a two-state-licensing-period exemption from the re-occupancy inspection following issuance of the certificate of occupancy, provided no Building Department violations are on file - the exemption is from the re-occupancy inspection only and does not waive the Township Clerk registration. The chapter also imports, by reference, the landlord-conduct duties of New Jersey's Truth-in-Renting Statement under N.J.S.A. 46:8-44 (required to be delivered to tenants in buildings of three or more units) and the Landlord Identity Registration form at N.J.A.C. 5:10-1.11. Compliance failures are enforced in Edison Municipal Court under the Chapter 17 penalty schedule; the chapter also authorizes denial of license renewal where conditions warrant.
Operating an unregistered rental, or making a material misstatement in the registration form, is a Municipal Court offense under Chapter 17 with a first-offense fine of $200, a second-offense fine of $500, and the Chapter 1 §1-5 maximum for any subsequent offense (each day of continued non-compliance can be charged as a separate offense). Occupying a unit without a current Rental Certificate of Approval at re-occupancy is an independent offense, also chargeable through the Division of Health. Pattern violations can be referred to the Township Clerk for denial of license renewal at the next March 1 cycle. New owners of Edison rental property must re-register the unit in their own name on transfer; failure to do so is enforceable in the same manner as initial-registration violations.
