Memphis, TN Rental Property Rules: Rental Registration (2026)

Chapter 5-44 of the Memphis Code of Ordinances created the city's short-term rental permitting system in 2023. Section 5-44-5(A) makes it unlawful for any person or entity to operate a short-term rental property, defined as a dwelling with three or fewer sleeping rooms rented to transients, or to advertise one for rent, without the owner first obtaining a permit issued by the Division of Public Works. An owner with more than one qualifying unit must obtain a separate permit for each unit, and any advertisement on a website, mobile app, or other hosting platform must display the assigned permit number under subsection B.

Applications, filed electronically or on forms the division prescribes, must include a site plan showing sleeping capacity, proof of ownership, a compliance verification form, proof of insurance, disclosure of any citations issued against the property in the prior 12 months, and the identity of a responsible party who lives within 50 miles and can respond in person to violation complaints. Section 5-44-5(D) sets a non-refundable $300 application fee that funds applicant screening and an on-site inspection, and the division may, though is not required to, inspect the property before issuing or renewing a permit.

Under subsection H, a permit expires 365 days after issuance; renewal costs $150 and the request must reach the division at least 30 days before the expiration date. The division can deny an application for false statements, an unpaid fine tied to the short-term rental ordinance, or delinquent city property taxes, and a permit denied, suspended, or revoked by any city or state agency within the preceding 365 days blocks a new application under subsection G.
