The Newark Housing Authority (NHA) administers thousands of Housing Choice Vouchers (Section 8) under HUD rules. Voucher holders search the private market; landlords who agree to rent must execute a HAP contract with NHA, pass a Housing Quality Standards (HQS) inspection, and accept a contract rent set at or below the area Payment Standard plus reasonable rent comparability. Under NJLAD (NJ Β§10:5-12), Newark landlords may not refuse vouchers categorically. Tenants pay roughly 30% of adjusted income; NHA pays the balance directly to the landlord. Newark also operates project-based voucher units in partnership with affordable developers under Mt. Laurel and COAH obligations.
Refusing vouchers, failing HQS inspection without timely repairs, or charging above-comparable rents can result in HAP termination, NJDCR action, and refund of overpayments to NHA.
