Buena Park sets no maximum number of bookings or nights per year for a permitted STR. Instead it limits supply: no STR may be within 300 feet of another, only one permit is allowed per individual, and the permit can be revoked if the unit is NOT rented at least 10 total days in any 12-month period.
Unlike some California cities that cap nights per year, Buena Park imposes no maximum number of rental nights. The FAQ states plainly: 'Is there a limit to how often I can short-term rent my home? There is no maximum number of bookings.' Instead, Buena Park controls STR concentration through other means. Section 19.348.080(D)(3) requires that the property line of an STR not be within 300 feet of the nearest property line of any other approved or conditionally approved STR - a hard spacing rule that sharply limits how many rentals can operate in any neighborhood. Section 19.348.080(E)(16) allows only one short-term rental permit per individual citywide at any time. Notably, the ordinance contains a minimum-use provision running the opposite direction from a night cap: under Section 19.348.080(I)(1)(d), the Director may modify, suspend, or revoke the permit if the host has NOT rented the short-term rental for a minimum of 10 total days within any 12-month period. The intent (per the recitals) is to keep STRs as genuine owner-hosted uses and prevent dormant or investor-held permits. Permits are valid three years with an annual inspection, and hosts must keep records of each date the unit was rented.
There is no penalty for too many nights, but operating a second STR, operating within 300 feet of another STR, or holding a permit while renting fewer than 10 days in a 12-month period are all grounds for the Director to modify, suspend, or revoke the permit. Operating any STR without a current permit is a misdemeanor or infraction under Chapter 1.04, with each day a separate offense.
