Neenah's Tourist Housing Ordinance at Section 26-661(2) of the Neenah Municipal Code expressly requires that all tourist housing property owners and guests abide by the citywide noise regulations in Section 11-146. Section 11-146 lists per-se prohibited noises in Neenah, including amplified-sound restrictions between 10:00 p.m. and 7:00 a.m. on weekdays (11:00 p.m. to 10:00 a.m. on weekends and holidays) and a flat ban on yelling, shouting, hooting, whistling or singing in residential areas between 10:00 p.m. and 7:00 a.m.
Neenah regulates short-term rentals as 'Tourist Housing' under Chapter 26 Article XV of the Neenah Municipal Code (Ordinance No. 2017-09). Section 26-661(2) makes compliance with the citywide noise ordinance an explicit condition of every tourist housing permit, so a single substantiated noise violation by a guest can become grounds for the Director of Community Development to revoke the permit under Section 26-663(1). Section 11-146(6) of Chapter 11 Article IV Division 3 prohibits the unreasonably loud and raucous use of a loudspeaker, amplifier, public address system or other sound-producing device adjacent to residential or noise-sensitive areas between 10:00 p.m. and 7:00 a.m. on weekdays, and 11:00 p.m. and 10:00 a.m. on weekends and holidays. Section 11-146(5) separately bars any radio, television, boombox, stereo or musical instrument that is plainly audible to a non-listener and unreasonably disturbs neighbors in single-family or multifamily residential dwellings. Section 11-146(7) bans yelling, shouting, hooting, whistling or singing in residential areas between 10:00 p.m. and 7:00 a.m. Section 11-146(13) prohibits unreasonably loud and raucous noise from any commercial establishment plainly audible from five feet of any residential property between 10:00 p.m. and 6:00 a.m. Section 11-145(c) makes the property owner and the legal tenant liable for noise complaints if police cannot identify the responsible person, and after two complaint investigations within 12 months the owner is deemed liable. Wisconsin Statute 66.1014 prevents Neenah from banning STRs of seven days or longer, but expressly preserves the city's authority to enforce noise rules against tourist housing operators and guests.
The Neenah Police Chief has primary enforcement authority for Chapter 11 Article IV Division 3 under Section 11-148(a) and may issue citations for violations of Section 11-146. Section 11-145(c) holds the property owner and legal tenant liable when police cannot identify the responsible party, and a second complaint within 12 months creates owner liability after written notice. Substantiated noise violations are also grounds for the Director of Community Development to revoke a tourist housing permit under Section 26-663(1).
