Berwyn, IL Short-Term Rentals: Occupancy Limits (2026)

Section 879C.06 forbids any owner from permitting occupancy of a short-term rental unit above the maximum number of persons for its bedroom count. The table runs in steps of two: 1 bedroom, 3 persons; 2 bedrooms, 5; 3 bedrooms, 7; 4 bedrooms, 9; 5 bedrooms, 11; and 6 bedrooms, 13. The column header reads Maximum Number of Persons in a Dwelling Unit At One Time, so the count is everyone present at once, guests and any others, not only the booked party. A day visitor who pushes the headcount past the limit still puts the owner over it.

The table stops at six bedrooms, and the code prints no separate row for a larger unit.

The owner carries the duty. Under Section 879C.05(G) the owner posts, inside the front entrance of every short-term rental dwelling unit, the city license stating the owner's name, a 24-hour telephone number and the maximum occupancy of the dwelling unit as allowed by the chapter. The posted number is therefore the figure from the Section 879C.06 table, visible to every guest on arrival. Inspection is built in: Section 879C.03 holds the license until the premises is inspected and approved, and Section 879C.05(E) subjects every rental to inspection by city representatives, including the Fire Department and the Building Department.

The definitions in Section 879C.01 show which units the table covers: single-family homes, individual rooms, accessory structures, townhomes, condominiums, rooming house units and units in multi-unit buildings. The chapter was enacted as Ordinance 23-27, passed 12-12-2023.
