Southampton, NY Short-Term Rentals: Short-Term Rental Parking Rules (2026)

Town Code § 270-9G requires owners and tenants of a rental property to ensure that all applicable parking regulations in the Town Code are satisfied, and then adds a rental-specific cap: "no more than four cars shall be parked at any rental property between the hours of 1:00 a.m. and 6:00 a.m. during the term of a rental period." This provision, added by Local Law No. 13-2017, functions as an overnight occupancy proxy, since a rental with more than four vehicles parked overnight often signals more tenants or guests than the property's occupancy and septic capacity were designed for.

It sits alongside the maximum-occupancy-per-bedroom rules in § 270-9B and the one-family occupancy rule in § 270-9A as part of the Town's broader effort to prevent "party house" rentals in unincorporated hamlets such as Hampton Bays, Flanders and Riverside. Dumpster placement is separately restricted under § 270-9J, which bans dumpsters in the required front yard and right-of-way and lets the enforcement authority impose additional site-specific parking and screening conditions attached in writing to the rental permit. Because the four-car overnight cap is a permit condition under Chapter 270, the Southampton Town Police and the enforcement authority's Ordinance Enforcement staff can document a count of vehicles present between 1:00 a.m. and 6:00 a.m. as direct evidence of a violation, independent of any separate zoning parking count for the property.
