If ownership changes by sale, deed transfer, death, a change in the entity that owns the property, sheriff sale or court order, the new owner must apply before renting, and is entitled to a permit if the new owner complies with the Part within three months of recording the deed.
Applications go to the Code Enforcement Officer on paper or electronically. Section 70-103 requires contact information for the owner and for a person in charge, who must live or have an office within 30 miles; floor plans and a site plan prepared by a licensed Pennsylvania professional showing bedrooms, maximum overnight guests and on-site parking spaces; a photograph from the access road; the Zoning Officer's use certificate; the current Erie County hotel room rental tax certificate of authorization and Pennsylvania sales and use tax permit; consent to inspection; the recorded deed; and proof of at least $500,000 in general liability insurance. A renewal application is due at least 60 days before the current permit expires.
Under § 70-104, a permit lasts one year and is approved only if the applicant has paid all fees, the unit passes inspection, and the premises complies with the International Fire Code and the International Property Maintenance Code as adopted in Chapter 29. Fees are set by resolution of the Board of Supervisors (§ 70-106).
