Casper, WY Sidewalk & Pedestrian Rules: Encroachment Permits (2026)

Casper Municipal Code section 12.24.020(A) prohibits any person from erecting or permitting awnings, canopies, marquees, advertising signs or similar installations that extend into, over or across any part of the Yellowstone-Rancho Road right-of-way (Wyoming Highway Project U-021-2 (24)) within the city, unless the installation stays at least two feet behind the curbline with a minimum ten-foot clearance from the sidewalk to the bottom of the sign, and unless all supports, braces or guy wires stay entirely outside the highway right-of-way. Subsection B grandfathers installations that were in place before September 18, 1967, and were supported entirely from outside the right-of-way, letting them remain "under a revocable permit from the city" subject to the stated limitations and restrictions, but requires full compliance with the setback and clearance rule the moment the owner undertakes extensive repair or maintenance on the structure.

Because the permit is revocable, the city retains ongoing authority to withdraw it if the installation stops meeting the section's conditions. The provision sits in Chapter 12.24, Obstructions, Article I, Street and Sidewalk Obstructions, within Title 12, Streets, Sidewalks and Public Places, and is one of the few sections in the code granting a private party continued use of city right-of-way for a fixed structure rather than simply banning encroachment outright.
