Homestead, FL Sidewalk & Pedestrian Rules: Encroachment Permits (2026)

Sec. 24-6 of the City Code sets a full fee schedule for right-of-way (ROW) permits covering sidewalks, curbs, driveway approaches, street pavement, landscaping, and utility installation within city rights-of-way. The base ROW permit application fee is $200 and includes a mandatory pre-construction meeting and site assessment; a 90-day extension costs $50 if requested at least seven days before expiration. Sidewalk, curb and gutter, or median work is billed at $50 per 50 linear feet or fraction thereof, with a $150 minimum, while driveway approaches run $100 up to 24 feet wide and $120 each beyond that.

Applicants must post a restoration bond equal to 110 percent of the value of the work, as determined by the director of public works, and pay a $75-per-hour inspection fee with a two-hour minimum. If a first inspection fails, reinspection runs $100, then $150, then $200 plus $75 for each additional failed check after the third. The most recent version of this fee structure was adopted by Ord. No. 2025-09-28 on September 9, 2025. Related Sec. 24-17 separately makes it unlawful for anyone to extend or maintain a wire, rope, cable, or line over, across, or under a city street or public highway without first obtaining permission from the city council, a companion permission requirement for above- or below-grade encroachments that fall outside the standard construction permit fees.
