Victoria's Unified Development Ordinance requires a License to Encroach for any new or existing improvement, structure, or facility that encroaches into a public street, roadway, sidewalk, right-of-way, or easement, both inside city limits and in the ETJ. The City Manager approves the license, and the Director of Development Services makes the final call on individual applications, with appeal to City Council. Encroachments into a street, roadway, or sidewalk also need separate City Council approval on top of the license. Staff can require an engineering study before sign-off.

Building or placing an encroachment without an approved License to Encroach is a code violation subject to enforcement under the UDO; an issued license also expires if the encroachment isn't installed within 24 months.
