Hamden, CT Sidewalk & Pedestrian Rules: Obstruction Rules (2026)

Section 96.35 of the Hamden Code of Ordinances, found under the 'Obstructing' heading of Chapter 96, prohibits two related things. First, no person may plow, plant or cultivate within the fence lines of any town street in a way that fills up or obstructs the street's drains or gutters, protecting stormwater flow along Hamden roadways. Second, and more broadly, no person may place or leave any obstruction in any town street or in or upon any footpath or sidewalk along those streets, except as otherwise provided elsewhere in the code, such as under a lawful § 96.01 work permit for sidewalk or curb construction.

Section 96.36 adds a companion violation provision aimed at intent, making it unlawful for any person, firm or corporation to knowingly or willfully violate § 96.35, which allows the town to pursue a stricter case where an obstruction was left deliberately rather than by oversight. Both sections trace back to the 1966 Code (§§ 59-25 and 59-26) and sit alongside the sidewalk maintenance duty in § 96.04, which already requires abutting owners to promptly remove and correct obstructions on their frontage; § 96.35 extends the obstruction ban to the streets themselves and to any person, not just the abutting owner.
