Las Cruces, NM Sidewalk & Pedestrian Rules: Sidewalk Repair (2026)

Sec. 26-71 sets the city's policy to maintain sidewalks in good repair through the general procedures in Division 2 of Chapter 26. Sec. 0 inches of differential), cracking, spalling/scaling, and blockage width, then builds a numerical priority ranking from that inventory. Sec. 26-73 requires an annual field inventory by the engineering department plus a periodic update process for public-reported problem spots. Sec. 26-74 governs who actually pays: as part of the budget process, staff recommends sidewalk repair funding, and the city repairs the total volume of listed sidewalks up to 90 percent of the funds budgeted for that purpose.

On cost recovery, where the cause of damage can be traced to the property owner or someone the owner permitted, the city pursues cost recovery as state law and city ordinance allow. Where a sidewalk is damaged by tree roots, the city repairs the sidewalk itself and may remove the offending tree from the right-of-way, offering the abutting owner a replacement tree of at least a 24-inch box container with a 2¼-inch caliper trunk from a city-approved list. Every other segment not covered by those two categories is the sole responsibility of the city to repair. The director of development services can also order a hazardous tree removed at the city's discretion under Sec. 26-74(c).
