In Neenah, the City, not the abutting property owner, pays to fix a hazardous sidewalk caused by cracking, unevenness or bad drainage, unless the owner, their contractor, or a utility caused the damage.
Where a hazard to pedestrian traffic exists due to uneven surface, cracked surface, spilling, standing water or improper grading of an existing sidewalk, in front of any lot or parcel within the City, the cost of repairs of such sidewalk shall be borne by the City. The Department of Public Works shall establish a written policy defining defective sidewalks. This section does not apply to sidewalk repairs undertaken at the option of the property owner where no hazard exists and, in those cases where the sidewalk/trail has been damaged through the negligence of the property owner, contractor, utility or builder, the cost for repair or replacement will be 100 percent the responsibility of the property owner or negligent party.
