Summary

Montgomery, Alabama bans new outdoor advertising structures next to interstate and primary highways under City Code Appendix C, Article IX, unless they fall into a narrow list of exceptions such as on-site sale or activity signs. Qualifying commercial-zone billboards are capped at 1,200 square feet, 30 feet tall, and spaced at least 1,000 feet apart along interstates.

Upon the effective date of article IX, no outdoor advertising structure shall be erected or maintained adjacent to an interstate or primary highway in the geographical jurisdiction of the City of Montgomery, except the following:(1)Directional and other official signs...(2)Outdoor advertising structures advertising the sale or lease of property upon which they are located;(3)Outdoor advertising structures advertising activities conducted on the property on which they are located;(4)Outdoor advertising signs in existence in business areas on the effective date of this ordinance and outdoor advertising signs to be erected in areas zoned commercial, industrial, or business, which adhere to the guidelines set forth in this article IX in section 3 governing size, lighting, and spacing of structures. ... On all interstate highways and freeways and/or major arterial highways, height of sign structures shall be limited to 50 feet maximum or 30 feet above the grade of the highway to which it is oriented, whichever is greater, unless a variance to exceed this height has been granted by the board of adjustment.

Full Breakdown

Article IX was adopted under Alabama's 1971 Highway Beautification Act to control outdoor advertising in the "adjacent area," defined as land within 660 feet of the right-of-way of any interstate or federal-aid primary highway. Section 1 makes it unlawful to erect or maintain an outdoor advertising structure in that adjacent area unless it is a directional or official sign, a sign advertising the sale or lease of the property it sits on, a sign advertising an activity conducted on that same property, or a commercial/industrial/business-zoned billboard that follows the Section 3 guidelines on size, lighting and spacing.

Section 3 caps any qualifying sign at 1,200 square feet of face area, 30 feet in height and 60 feet in length, and allows a single structure to carry two faces (double-faced, back-to-back or V-type) as long as the combined area of two same-direction faces stays within 1,200 square feet. Spacing rules require 1,000 feet between sign structures on the same side of an interstate, 500 feet along other qualifying highways, and allow the distance to drop to 250 feet if one of the two structures carries no face larger than 150 square feet.

Height on interstates and freeways is capped at 50 feet, or 30 feet above the highway grade, whichever is greater, unless the board of adjustment grants a variance; on primary highways inside city zoning authority, height instead follows the underlying zoning district. Section 4 requires any lawful nonconforming billboard to be removed within five years of becoming nonconforming, though the board of adjustment can let outdoor advertising signs remain longer, and a sign damaged beyond 60 percent of its replacement value cannot be rebuilt except in conformity with the article.

Violations & Fines

Erecting or maintaining a freeway-adjacent sign that violates Article IX's placement, size, spacing or height limits is enforced under the zoning ordinance's general Article II. Violators are punished under City Code Section 1-6, with each day of a continuing violation charged as a separate offense, and the city or an affected property owner may seek injunctive relief to force removal of a nonconforming or unlawful sign structure.

Frequently Asked Questions

Can I put up a billboard next to I-65 or I-85 in Montgomery?
Only in narrow circumstances. Article IX bans new outdoor advertising structures within 660 feet of an interstate or primary highway right-of-way unless the sign advertises the sale, lease or on-site activity of the property it sits on, or is a commercial-zone billboard that meets the Section 3 size, lighting and spacing standards, including the 1,000-foot interstate spacing rule.
How big can a freeway billboard be in Montgomery?
Section 3 limits any qualifying sign to 1,200 square feet of face area, with a maximum height of 30 feet and length of 60 feet, measured by the smallest shape that encloses the whole sign face, excluding the base, apron and structural supports. A structure can carry two faces if their combined area on the same side stays within that 1,200-square-foot cap.
What happens to an old billboard that no longer meets the rules?
Section 4 treats it as a lawful nonconforming structure that can stay in place but cannot be extended or structurally altered, and it must be removed within five years of becoming nonconforming unless the board of adjustment allows it to remain longer. If it is damaged beyond 60 percent of its replacement value, it cannot be rebuilt except in full compliance with Article IX.
