Full Breakdown
Roseville regulates door-to-door sales through the nuisance chapter, Sec. 405.03(13). Sec. 405.01 defines peddling and soliciting as going house-to-house, door-to-door, business-to-business, street-to-street, or any other place-to-place to offer property or services.
Subsection (13)a lists manners of peddling or soliciting that are nuisances: obstructing the free flow of vehicular or pedestrian traffic on any street, alley, sidewalk or other public right-of-way; creating a threat to the health, safety and welfare of any individual or the public; doing so before 9:00 a.m. or after 7:00 p.m.; making false or misleading statements about the product or service, including untrue statements of endorsement; remaining on the property of another when requested to leave; and acting in a manner a reasonable person would find obscene, threatening, intimidating or abusive.
Subsection (13)b is the no-knock rule. A peddler or solicitor may not enter the property of another, unless invited by the property owner or tenant before entering, when the property is marked with a sign or placard that is at least four inches long and four inches wide, has print at least 48-point in size or one half inch tall, and states "no trespassing" or "no peddlers or solicitor," or "peddlers and solicitors prohibited" or another comparable statement. Subsection (13)c makes it a nuisance for anyone other than the property owner or tenant to remove, deface or tamper with a sign displayed under (13)b.
The code in Sec. 405.03(13) works through the posted sign and the hour limits. It does not print a list or registry that a resident signs up for. The community development director administers and enforces Chapter 405 under Sec. 405.06, and the public works director takes nuisances impacting the public right-of-way.
Violations & Fines
Maintaining a public nuisance is unlawful under Sec. 405.05. Under Sec. 405.07 the enforcing officer notifies the owner or occupant in writing and sets a time, not exceeding 30 days, to abate, and unresolved matters go to the city council with at least ten days of notice. Sec. 102.01(a) sets the general penalty for a Code violation at a misdemeanor with a fine not to exceed $1,000.00, imprisonment not to exceed 90 days, or both.
