Full Breakdown
Section 155-12 of the Stafford Township Code, added in December 2019, forbids any individual or group from knowingly entering private property that displays a "No Solicitation" sticker or is on the No Solicitation Registry. The Township Clerk prepares the list of addresses where the owner or occupant has notified the Clerk that canvassing, commercial solicitation, peddling, itinerant vending and door-to-door sales enterprises are not permitted. Joining takes a form available at the Township Clerk's office during normal business hours, and the list is updated monthly. A registered owner or occupant can pick up a sticker cling in person; the first is free and a replacement carries no charge.
The duty falls on the seller. Under subsection C, the Clerk hands the current registry to each licensee when a license to peddle, canvass, itinerant vend or sell door to door is issued, and the licensee cannot peddle, canvass, solicit, itinerant vend or conduct door-to-door sales at any listed address. Under subsection D, it is the responsibility of the canvasser, itinerant vendor or solicitor to have the most up-to-date list before working.
Charities are treated differently. Subsection F says solicitation does not include communications by charitable organizations as defined in the chapter. Their members do not have to register with the Clerk, but they cannot conduct door-to-door fundraising at any residence with a visible "No Solicitation" sticker cling. The definitions in § 155-1 of canvassing and commercial solicitation reach listing requests for real property and for-profit approaches, including the purchase or intimidation of residents to sell their real property.
The registry works alongside the hours rule in § 155-7D: no selling or soliciting is permitted except between 7:00 a.m. and 7:00 p.m., inclusive. Home deliveries of milk, bread and the like are not circumscribed, trucks peddling coffee, doughnuts and similar items to work sites are not limited, and ice cream vendors can operate until 8:00 p.m. from May 20 through September 20.
Violations & Fines
Under § 155-12E, a canvasser, commercial solicitor, peddler, itinerant vendor, or owner or employee of a door-to-door sales enterprise convicted of violating the section faces a maximum ordinance violation fine of $1,250 for the first offense, up to 90 days in the county jail or another place provided by the municipality for any offense after that, and permanent revocation of any license issued under the chapter. Section 155-13 separately sets a fine of not more than $1,000 for other Chapter 155 violations. The Police Department, Code Enforcement Officer or Zoning Officer enforces the chapter.
