Full Breakdown

Section 155-2 of the Stafford Township Code makes it unlawful for an itinerant salesman or vendor to sell or offer goods, wares or merchandise anywhere in the Township, or to solicit funds, subscriptions or contributions, without first applying for and obtaining a permit. Section 155-1 defines the term to cover hawkers, peddlers and salesmen with no retail shop or place of business in Stafford, whether they work the streets or go door to door. Wholesalers licensed by New Jersey or holding a state sales tax exemption permit are excluded by § 155-3, and anyone holding a special license under N.J.S.A. 45:24-9 is exempt from the chapter's licensing requirements.

The sworn application is filed with the Chief of Police on forms provided by the Township Clerk. It lists the applicant's name and address, the principal officers and managers if the applicant is not an individual, a description of the goods or the purpose of the solicitation, and the beginning and ending dates. Applicants also submit two letters of recommendation about moral character, and where applicable must present proof of a food handler's license issued by the County of Ocean. The fee at filing is $150, reduced to $50 if the Stafford Township Police Department already investigated the applicant in the same calendar year and a license issued.

After the Chief of Police endorses approval, the Township Clerk delivers the permit on payment of the license fee. Under § 155-7, the permit costs $15, expires December 31 following issuance, and covers one person and one vehicle; a duplicate for each added person or vehicle costs another $15. Under § 155-6, the Clerk issues a badge reading "licensed solicitor" or "peddler" with the license number legible from 10 feet, worn on the front of the outer garment, and two vehicle stickers for each vehicle. A permit to solicit for a recognized charitable or religious organization carries no fee and expires not more than 40 days after issuance.

Violations & Fines

Under § 155-13, a conviction under Chapter 155 carries a fine of not more than $1,000, imprisonment for up to 90 days, community service of not more than 90 days, or a combination set by the Municipal Court Judge, with each day a separate offense. The Chief of Police can revoke a permit for continued violations or good cause, and must suspend it on a third conviction in a calendar year, with a hearing within five days. The Police Department, Code Enforcement Officer, Zoning Officer or a designee of the Township Council enforces the chapter.

Frequently Asked Questions

What hours can a permitted solicitor or peddler work in Stafford Township?
Section 155-7D allows selling or soliciting only between 7:00 a.m. and 7:00 p.m., inclusive. Home deliveries of milk, bread and the like and trucks peddling coffee, doughnuts and similar items to work sites are not limited by those hours, and ice cream vendors can operate until 8:00 p.m. from May 20 through September 20.
Do charities need a permit to solicit?
Yes, but with relief. Duly established charitable and religious organizations pay no application fee, submit no moral-character letters, and skip the investigation under §§ 155-4D and 155-5D. Their solicitation permit carries no fee and expires not more than 40 days after issuance, and agents wear a badge or ribbon with the organization's name and address.
How long does the Township have to decide, and can a denial be appealed?
Section 155-8 requires a grant or denial within 21 days of submission to the Chief of Police. A denial comes by certified mail with reasons. Within five days the applicant can ask the Township Council for a hearing, which is held within 10 days of the request, and the Council decides within 10 days after the hearing.
Where do I get the application?
The forms come from the Township Clerk, but the sworn application is filed with the Chief of Police under § 155-4A. The $150 investigation fee is paid to the Township Clerk at filing, and the Clerk issues the permit and badge once the Chief of Police endorses approval.
