Chapter 175, Special Events, requires under § 175-4A that no special event take place until an application for a special event permit has been submitted to and issued by the Town Clerk. m. Section 175-5A requires the application to be filed with the Town Clerk's office at least 15 business days before the event, though the Clerk can waive late filing if it will not impair the Town's review, and can also deny a permit for late or deficient filings. m. Section 175-7B lets the Town Clerk deny, revoke, suspend or modify a permit for reasons including inadequate Town resources, disturbance of public peace, prior violations within the last three years, or false statements in the application, and § 175-7C lets the Chief of Police, Code Enforcement Officer or Fire Marshal close an event outright if it becomes an imminent public safety hazard. Denials can be appealed to the Town Attorney within 30 business days under § 175-8, and permits are nontransferable under § 175-12.
Violations & Fines
Holding a block party or other special event without a permit, or contrary to the terms of an issued permit, is a violation under § 175-9, punishable under § 175-11 by a fine of not less than $100 nor more than $250 per offense or up to 15 days' imprisonment, or both, with each day of a continuing violation a separate offense; a revoked permit carries no refund of the application fee under § 175-7E.
