Summary

Anyone wanting to close a Hercules street for a block party or similar temporary use must apply to the Director of Public Works at least two weeks ahead under Section 7-1.303, showing adequate detour routes before a permit issues.

Sec. 7-1.303. Temporary Street Closure. When the temporary closure of a public street to pedestrian and/or vehicular traffic is requested by the permittee, the permit shall be applied for at least two (2) weeks in advance of the date of requested closure. The Director of Public Works shall determine the effect of the requested closure and, if satisfied as to adequate, available and alternate detour routes, may issue a permit, attaching such conditions as he may deem necessary for the health, safety and welfare of the public and for the protection of the City. When emergency situations arise due to unforeseen circumstances or other causes, the two (2) week period may be waived.

Full Breakdown

Section 7-1.303 of the Hercules Municipal Code governs temporary closure of a public street to pedestrian or vehicular traffic: the permittee must apply at least two weeks in advance of the requested closure date, and the Director of Public Works determines the effect of the closure and may issue the permit, attaching whatever conditions are necessary for public health, safety, and welfare, once satisfied there are adequate and available detour routes. The two-week advance requirement can be waived when an emergency situation arises from unforeseen circumstances. Because this section sits within the general Encroachment Permit chapter (Title 7, Chapter 1), a block party organizer applies through the same Public Works permit process used for any encroachment, providing the location, dates, and purpose of the closure per Section 7-1.202's application requirements, and posting the fees and any cash deposit or bond the Director sets under Sections 7-1.213 and 7-1.215 to cover restoration of the street afterward.

Violations & Fines

Closing a street without the required permit, or violating conditions attached to it, falls under the citywide default penalty of Section 1-4.01: a misdemeanor punishable by a fine of up to $1,000, imprisonment of up to six months, or both, with each day treated as a separate offense. The Director of Public Works may also cancel the permit and restore the street at the permittee's expense under Section 7-1.301 if required safeguards like barriers or warning signs are not maintained.

Frequently Asked Questions

How far ahead do I need to apply to close a Hercules street for a block party?
At least two weeks before the requested closure date. Section 7-1.303 requires the permit application at least two weeks in advance so the Director of Public Works can assess detour routes before deciding whether to issue the permit.
Who approves a temporary street closure in Hercules?
The Director of Public Works, who may issue the permit once satisfied there are adequate, available, and alternate detour routes, and who can attach conditions for public health, safety, and welfare under Section 7-1.303.
Can the two-week notice for a street closure be skipped?
Yes, but only for emergencies. Section 7-1.303 allows the two-week period to be waived when emergency situations arise due to unforeseen circumstances or other causes; a planned block party does not qualify for that waiver.
