Full Breakdown
Town Code § 10-02-040(A) prohibits, at all times in all Town parks, playgrounds and outdoor recreational areas, the possession of any open container of spirituous liquor and its consumption, unless authorized Town officials expressly permit it. Section 10-02-060 is the permit route around that ban. The applicant files with the Town Clerk, and the Town Council, not park staff, decides at its sole discretion whether to authorize the applicants and their invitees to possess or consume liquor in a park, playground, outdoor recreational area, or other property owned or operated by the Town.
Each permit must specify the names of the applicants, the persons in charge of the authorized group or function if they differ from the applicants, the nature of the group or function, and the types of invitees expected. It must also name the specific locations where possession or consumption is authorized and the times and dates. The applicant remits a fee to the Town Clerk at the time of application, in the amount listed in the Comprehensive Fee Schedule. If a permit is issued but never used for any function, refunds are issued only in accordance with policies established by the Parks & Recreation Department. Subsection D adds that nothing in the permit excuses compliance with Title 4 of the Arizona Revised Statutes on the sale of spirituous liquor, so a Town permit to drink does not authorize selling drinks.
Section 10-02-080 covers everything else the Town owns. The Council must have Town Facilities Usage Policies and Procedures in place for the lawful, timely, effective, equitable, and consistent administration of real and personal property in which the Town has an interest, inside and outside the Town limits. The policies apply to any person, firm, association, organization, partnership, company or corporation that wants to occupy or use that property. The Council adopts and modifies them by resolution, and the Town Manager or a designee administers them and is authorized to promulgate rules and regulations to carry them out. The Code itself prints no booking steps, deposit amounts or capacity limits; those sit in the policies and the fee schedule.
Specialty Parks add a second approval layer. Under § 10-02-040(B), the Mountain Valley Skate/Bike Park, designated off-leash areas, Pickleball Courts and parks with synthetic athletic turf allow organized use, including programs, lessons, scheduled competitive and demonstration events, only with the express approval of the Parks and Recreation Department. Glass containers are prohibited in all Town parks under § 10-02-040(A)(11).
Violations & Fines
Section 10-02-070 makes any violation of this Article a misdemeanor under § 1-08-010(A). That section treats a misdemeanor with no stated class as a class 1 misdemeanor, punished under A.R.S. §§ 13-707 and 13-802, and counts each day a violation continues as a separate offense. Section 1-08-010(B) also makes any Code violation a civil offense carrying a civil sanction not to exceed $2,500.
