(11) Parklets. The City Manager or designee, upon application on a form prescribed by the City Manager's office and payment of all applicable fees, may issue a permit to allow for the installation and operation of a parklet within a City public right-of-way upon finding that the proposed parklet complies with the following standards and conditions: (a) Will not obstruct vehicular or pedestrian traffic; and (b) Will not create a hazard to person or property; and (c) Will not create a noise disturbance, breach of the peace, or any other violation of a provision of this code; and (d) Will comply with City-approved design and construction standards established by the most current version of the "Parklet Design and Construction Standards" as set forth in administrative regulations adopted and issued by the City Manager.

Violations & Fines
Installing a parklet in the right-of-way without a § 2.185(11) permit, or one that fails the design and construction standards, exposes the operator to permit denial and the same revocation-without-notice exposure that applies to other right-of-way permits under § 2.190(1)(b). The City Manager can also require repair bonds or cost reimbursement for any damage caused by an unauthorized or nonconforming installation.
